One of the main issues that concern people in the purchase, sale, gift and inheritance of real estate is whether they have to pay a tax? The RIA Reality Site, together with lawyers, decided to make a taxpay for owners, sellers and real estate recipients.

When do you have to pay a tax on real estate?

Only the proceeds of sale of property owned by the taxpayer for three years or more are exempted from taxation (art. 217, para. 17.1). The minimum period of tenure for immovable property is three years for immovable property that is subject to at least one of the following conditions:

(1) The right of ownership of the real estate property has been acquired by the taxpayer in succession or by a contract of gift from an individual recognized by a family member and (or) by a close relative of that taxpayer under the Family Code of the Russian Federation;

(2) The right of ownership of the immovable property is obtained by the taxpayer as a result of privatization;

(3) The right of ownership of the immovable property is obtained by a taxpayer, a renter, as a result of the transfer of life-saving equipment under the contract.

In cases not specified above, the minimum period of tenure of the real property Five years.

In the sale of real property owned by a natural person for less than three years, it is necessary to calculate and pay taxes by filing a tax inspection declaration.

The deadline for filing a declaration is 30 April, following the year of sale of real property or its share. The declaration is submitted to a tax inspection at your place of residence.
